Pauldohert 12-16-2005, 07:12 AM I have a phone contract for two years, the warrantee is only for one year.
The phone doesn't work, the years warrentee is up - the company won't replace the phone and won't cancel the contract.
Surely this can't be legal to be forced to pay for something that doesn't work?
I can't say which company it is but it is a well established telecoms company that is British.

There's also the CAB to check your rights, although if the waranty is up then they're being all "jobsworth" about it.
I would suggest that you attack the company along the lines of - ok, the waranty is up but only just, so a jesture of goodwill (on their part) would be nice like a 50% reduction on a new phone or some other compromise maybe?
Any chance of going via the makers of the phone?
I know that some British Telecommunications companies can be totally non-interested in customers after they've got the sale / contract.

I thought a mobile contract was a rent of a mobile handset, if the thing you are renting doesn't work, they either replace it or you cease to pay.
But no , I have to continue to rent a phone which doesn't work. - I suppose I will save a fortune in call charges:confused:
(God knows what the warrentee was for? I didn't purchase this phone personally - it was a gift!)
Sounds very dodgy to me.
Is this just a tactic to deny you all rights, till you complain vigorously enough?

If you don't make a fuss then they'll ignore you - sadly in the UK, all customers have to make a fuss to get anywhere with big companies.

I rang my company the weekend to get a free upgrade because the last phone I had appr. 6mnths ago, again as a free upgrade, packed up.
The phone turned up this morning, sounds like you guys picked the wrong company:cool:

GaryPanic 11-14-2007, 02:31 PM when you start a contract with a mobile phone (Provider) its not the actual phone you are doing it with - its the service provider the phone is just a means to use the service - they are barstards like that - which is why you can get free upgrades - and not sign a new contract - cos if it was on the phone - you would need a new contract unless the contract was written in a set way to be any phone provideed by the service provider - which could also mean a substandard phone - mind you i am not a fan of the Molbile phoen - so not a good one to really ask -

Howz everyone?....Recently I watched a documentary on IPhones contract and what they were saying is if you loose your phone you will have to make a new contract/renew your contract...so watch it out if you are going for one...

Nope, you buy the handset outright or the phone company in question simply absorbs the cost of the handset, or substantially subsidises it in order to tie you into the monthly "line" rental (and associated call, text, GPRS charges and so on where they actually rake in the cash). Try buying one of those top range handsets without a contract and see what it costs you compared to if you sign up with <insert network of choice> (hint, it's around £3-400)
It's one of the "fun" aspects of the UK mobile phone market, now that from a customer point of view it's a saturated market, the emphasis has shifted from giving you stuff to join the network to tying you into a longer contract to keep there, hence the move towards 18month minimum contracts and the removal of a lot of the handset subsidies, especially at the lower end of the contract market.
Plus with 12month manufacturer warranties, they can now sell you phone insurance at £6 per month for when it inevitably packs in after 366 days.
