Look at it this way. If they make the cups sturdier, then you have less (still not zero) chance of repetition, and your coffee is sterilized. (All it takes is 168 degr. F to reach that point.)

A plaintiff whose goal was to force them to make their product safer would have sought equitable relief of some kind, perhaps an injunction.
