Create a chart from a filtered table (1 Viewer)

I am trying to create a pie chart from a table. The rowsource of the graph is set to the table. However, I would like the graph to represent only the records that are selected by a user using a list box. What is the best way to solve this.
PS. I tried basing the graph on a parameter query, it works perfectly.. but I can not use the parametes as the header of the report. Kind of a catch 22. Any help will be greatly appreciated.
