It may take a while because of the serious entrenchment involved, but the dissolution of the Chevron Deference Doctrine might enable someone to sue over a particular ruling that declares an area to be protected. Those rulings that were made by Executive Branch fiat could be overturned based on being an unconstitutional violation of the "Separation of Powers" policy.
